Counter-Notices must be sent to the Designated Copyright Agent listed in Section 2.
Upon receipt of a valid Counter-Notice, Circl will forward it to the party who submitted the original DMCA Notice. If that party does not file a lawsuit seeking a court order against the user within ten (10) to fourteen (14) business days, Circl may, at its discretion, restore the removed material.
In accordance with the DMCA and applicable laws, Circl has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.
Circl may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is repeat infringement.
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
Although Circl operates under French law, we honor copyright protection internationally. If you are located outside the United States and wish to report copyright infringement under your local copyright framework (such as the EU Copyright Directive, the UK Copyright, Designs and Patents Act, etc.), you may use the procedure described above. Please clearly identify the applicable law in your notification.
This DMCA Policy applies only to claims of copyright infringement. For other types of intellectual property claims (trademark, right of publicity, etc.) or other violations of our Community Guidelines, please contact contact@app-circl.com.
